This Privacy Policy explains how Bear Power Solutions, LLC ("Bear Power Solutions," "BPS," "we," "our," or "us") collects, uses, and shares information when you visit bearpowersolutions.com (the "Site"), request a quote, buy from our online store, or contact us by phone or email.

Bear Power Solutions is a transformer supplier based in Jackson, Mississippi. We supply pad-mount, pole-mount, substation, dry-type, and power transformers, plus transformer oil, to business customers in the continental United States.

Information we collect

Information you give us

Quote and contact requests. Our website quote and contact forms ask for your name, company, email address, and phone number. Depending on the form, they may also ask for details about the equipment you need or want to sell, such as transformer type, kVA rating, voltages, quantity, needed-by date, site location, condition, PCB status, pickup city and state, gallons of oil needed, project timeline, and any message you add.
Orders. When you buy through our online store, we collect what is needed to process and fulfill your order: name, company, billing and shipping addresses, email, phone, the products you order, and order notes. Card payments are handled by our payment processor (see "Payments" below).
Accounts. If you create or log in to an account on the Site, we keep your login details and account information, along with your order history.
Communications. When you call or email us, we keep your contact details and the content of the communication so we can respond and keep business records.
Text message opt-outs. If you ask us to stop sending you text messages, we keep a record of your request so we can honor it (see "Text Messaging (SMS) Program" below).

Information collected automatically

When you use the Site, we and our service providers automatically collect certain technical information, such as:

IP address, browser and device type, operating system, and referring website
Pages viewed, products viewed or added to your cart, and how you move through the Site
How you arrived at the Site (for example, a search engine, a link on another site, or a campaign link), which our store uses to attribute orders to a traffic source
Cookies and similar technologies, described in "Cookies and analytics" below

Information from others

Payment and fraud-prevention information from our payment processor, such as whether a payment was approved and fraud-screening results.
Shipping and delivery status information from freight and logistics partners.
Information from your company or colleagues when they request quotes or place orders on your behalf.

How we use information

We use information to:

Respond to quote requests and questions, and prepare and follow up on quotes
Process, fulfill, ship, and support orders, including pickups, hotshot, and LTL freight deliveries
Arrange the purchase or pickup of scrap and surplus equipment
Send transactional messages about your quotes, orders, deliveries, and account
We do not send marketing text messages (see "Text Messaging (SMS) Program").
Send marketing and promotional emails about our products, inventory, and services (see "Marketing emails"). You can unsubscribe at any time. We never use text messages for marketing.
Manage customer relationships and keep track of our quotes, orders, and communications with you
Operate, secure, and improve the Site, including preventing spam form submissions and fraudulent orders
Understand how visitors use the Site and which pages and products are most useful
Keep business, tax, and accounting records and meet legal obligations
Protect our rights, our customers, and others

How we share information

We do not sell your personal information.

We share information only as described below:

Service providers that help us run the business and the Site. These include our website host (Bluehost); our WordPress and WooCommerce store platform and plugins, including WPForms for our website forms; site analytics (Jetpack) and spam prevention (Google reCAPTCHA); our email providers; our phone and texting provider (Grasshopper); and HubSpot, our customer relationship management (CRM) and email marketing software. They may use the information only to provide services to us.
Payment processors, which process card payments and screen for fraud. They handle your payment card details under their own terms and privacy policies. We do not store full card numbers on our Site.
Shipping carriers, logistics partners, and suppliers, only as needed to fulfill your order, such as the names, addresses, and contact details needed to source, pick up, and deliver it.
Legal and safety. We may disclose information when we believe the law requires it, to respond to legal process, to enforce our agreements, or to protect the rights, property, or safety of BPS, our customers, or others.
Business transfers. If BPS is involved in a merger, acquisition, or sale of assets, information may be transferred as part of that transaction.
With your consent or at your direction.

Text messaging exception: none of the sharing described in this section includes text-messaging consent or opt-out data, or mobile phone numbers collected for text messaging. See "Text Messaging (SMS) Program" below.

Payments

Online card payments are processed by our third-party payment processor through our WooCommerce store. Your card details go directly to the payment processor, and we do not store full card numbers on our Site. The processor may collect device and transaction information to prevent fraud. Its own privacy policy governs how it handles that information.

Cookies and analytics

Cookies are small files that a website stores in your browser. We and our service providers use cookies and similar technologies for the following purposes:

Essential store functions. WooCommerce uses cookies to keep track of your cart and session and, if you log in, your account session. Without them, the cart and checkout will not work.
Order attribution. Our store records how visitors arrive at the Site, such as the referring site or campaign, and stores that in cookies so the source can be attached to an order.
Site statistics. We use Jetpack, an Automattic (WordPress.com) service, to collect aggregated statistics about page views and visits, including store analytics for activity such as product views and add-to-cart events.
Spam prevention. Some of our forms use Google reCAPTCHA to tell people from bots. reCAPTCHA collects hardware and software information and sends it to Google. Google's Privacy Policy and Terms of Service apply.
Payments. Our payment processor may set cookies or use similar technologies on store and checkout pages for fraud prevention and payment features.
Fonts and images. The Site loads fonts from Google Fonts and may serve images through a WordPress.com content delivery network. These services receive your IP address and browser information when your browser requests the files.

How to control cookies: most browsers let you block or delete cookies in their settings. If you block essential cookies, the cart, checkout, and account features may not work. We do not currently respond to browser "Do Not Track" signals.

Marketing emails

We may send marketing and promotional emails about our products, inventory, and services, such as available transformer inventory, transformer oil, and our scrap and surplus buying programs, to customers and business contacts. We send these emails through HubSpot, our CRM and email marketing service provider.

Every marketing email identifies Bear Power Solutions as the sender, uses accurate sender information and subject lines, includes our postal mailing address, and includes a working unsubscribe link.
You can opt out of marketing emails at any time by clicking the unsubscribe link in any marketing email or by contacting us using the details in "Contact us." We honor opt-out requests promptly, and no later than 10 business days after we receive them.
Opting out of marketing emails does not stop transactional and relationship emails, such as quotes, order confirmations, invoices, shipping and delivery updates, account notices, and replies to your requests.
Our email service provider may tell us whether a marketing email was opened and which links were clicked, so we can understand what content is useful. You can limit this by turning off automatic image loading in your email program.
We do not sell or rent our email lists.
Text messages are separate from email. We never use text messages for marketing or promotional purposes, and signing up for or receiving our emails does not sign you up for text messages.

Text Messaging (SMS) Program

This section explains our approach to text messages and how we handle mobile information. Our full SMS Terms are posted at bearpowersolutions.com/sms-terms/ and are summarized here.

Sender. Any text messages we send come from our local business number, 601-912-3512, under the name "Bear Power Solutions" (Bear Power Solutions, LLC).
No text sign-up on our website. Our website forms do not include a text message sign-up box. Submitting a form, giving us your phone number, or doing business with us does not by itself sign you up for text messages.
Types of messages. Any text messages we send are customer-care and transactional messages only: quotes and quote follow-ups, order confirmations and updates, scheduling, and pickup and delivery coordination. We do not send marketing or promotional text messages.
Texting is not required. You do not have to agree to receive text messages to request a quote or buy from us. You can also reach us by phone or email.
Message frequency varies.
Message and data rates may apply. Your mobile carrier's standard message and data rates may apply. Contact your carrier for details of your plan.
Opting out. You can opt out at any time by replying STOP to any message from us. We also honor END, CANCEL, UNSUBSCRIBE, QUIT, and similar plain-language requests, as well as opt-out requests made by phone or email. After you opt out, we will send one final message confirming it, and then no further text messages unless you ask us to start again.
Help. Reply HELP to any message for help, or contact us at 601-912-3512 or sales@bearpowersolutions.com.
Carriers. Mobile carriers are not liable for delayed or undelivered messages.
Opt-out records. We keep records of text message opt-out requests so we can honor your choices.
Sensitive information. Text messaging is not a fully secure form of communication. Please do not send payment card numbers or other sensitive financial or personal information by text.

How we protect your mobile information: we do not sell, rent, or share your mobile phone number or your text message opt-in data and consent with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

How long we keep information

We keep personal information for as long as we need it for the purposes described in this policy, including to provide quotes, products, and support, to meet our legal, tax, and accounting obligations, to resolve disputes, and to enforce our agreements. We keep text message opt-out records, and any earlier text message consent records, for as long as needed to honor your choices and meet our legal obligations. Site analytics and log data are kept according to our service providers' settings.

When we no longer need information, we delete it or de-identify it.

Security

We use reasonable administrative, technical, and physical safeguards to protect personal information. These include encrypted (HTTPS) connections to the Site and using an established payment processor for card payments. No website, email, or text message transmission is completely secure, and we cannot guarantee absolute security.

Your choices and rights

Access, correction, and deletion. You can ask us for a copy of the personal information we hold about you, or ask us to correct or delete it, by emailing ledger@bearpowersolutions.com or calling 601-912-3512. We may need to verify your identity before acting on a request. We may keep certain information where the law requires it or for legitimate business purposes such as order, tax, and accounting records.
Account information. If you have an account on the Site, you can review and update your account details by logging in.
Marketing emails. You can opt out of marketing emails at any time with the unsubscribe link in any marketing email or by contacting us. We will still send you transactional emails about your quotes, orders, and account. See "Marketing emails" above.
Text messages. Reply STOP to opt out, or HELP for help, as described in "Text Messaging (SMS) Program."
Cookies. See "Cookies and analytics" above.
State privacy rights. Some U.S. states give residents additional rights over their personal information. If you live in one of those states and want to make a request, contact us using the details below. We will respond as required by applicable law.

Children's privacy

The Site is intended for business customers. It is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has given us personal information, contact us and we will delete it.

Links to other websites

The Site may link to other websites and services, such as Google Maps for directions, manufacturer or product resources, and payment or shipping providers. We are not responsible for the privacy practices of those sites. Please review their privacy policies.

Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will post the updated version on this page and change the effective date at the top. If we make material changes, we may provide additional notice where appropriate.
